1. PURPOSE AND NATURE OF EVERCHANGE

EverChange provides private, one-on-one personal coaching
designed around the individual needs, circumstances, challenges, and
goals of each client.

EverChange does not operate as a walk-in office, clinic, treatment
centre, or group counselling facility. Coaching is provided remotely
through direct personal correspondence and communication between
EverChange and the individual client.

Each coaching relationship is personal. The approach, communication,
exercises, guidance, goals, and ongoing work may be individually
developed and tailored to the particular client rather than provided
through a one-size-fits-all program.

The purpose of EverChange is to work personally with individuals seeking
meaningful change in their lives by providing guidance, encouragement,
accountability, perspective, practical strategies, and continued
one-on-one support.

2. COACHING – NOT MEDICAL OR MENTAL HEALTH TREATMENT

EverChange provides personal coaching services.

Unless expressly stated otherwise in writing, EverChange does not
provide medical care, psychiatric treatment, psychotherapy,
psychological diagnosis, clinical counseling, addiction treatment,
detoxification, rehabilitation, or other regulated health-care services.

The personal nature of the coaching relationship does not transform
coaching into medical, psychiatric, psychological, or other regulated
professional treatment.

Nothing communicated through EverChange should be interpreted as
medical, psychiatric, psychological, legal, financial, or other
regulated professional advice.

Where a client’s circumstances require services outside the scope of
coaching, the client is responsible for obtaining assistance from an
appropriately qualified professional.

3. REMOTE AND CORRESPONDENCE-BASED SERVICES

EverChange services are provided remotely rather than through an
in-person office or clinic.

Communication may occur through methods made available by EverChange,
including personal correspondence, email, telephone, video communication,
messaging, written materials, or other agreed methods.

Because EverChange works individually with each client, the nature and
frequency of correspondence may differ from one client to another.

The availability of a particular communication method does not mean that
EverChange provides continuous, 24-hour, emergency, or on-demand access.

5. PERSONAL RESPONSIBILITY

EverChange recognizes that meaningful change is personal and that each
client’s circumstances are different.

The coach may provide observations, suggestions, encouragement,
exercises, strategies, and perspectives tailored to the client’s
circumstances. However, the client remains responsible for all personal
choices, actions, decisions, health, safety, relationships, finances,
employment, and other circumstances.

The client decides whether and how to act upon information discussed or
communicated during the coaching relationship.

6. INDIVIDUALIZED COACHING RELATIONSHIP

The EverChange coaching relationship is built around direct communication
and individual participation.

Clients are encouraged to communicate honestly about their goals,
challenges, progress, and circumstances so that the coaching process can
be appropriately tailored to them.

The fact that a particular method, strategy, or approach is used with one
client does not mean that it will be appropriate for another client.

EverChange may modify the coaching approach as the client’s circumstances,
goals, or progress develop.

EverChange also reserves the right to decline, discontinue, or terminate
a coaching relationship where the client’s needs fall outside the scope
of the services offered, continued coaching would be inappropriate,
there are safety concerns, the relationship is being misused, or the
coaching relationship is no longer reasonably productive.

7. NO GUARANTEE OF RESULTS

EverChange is committed to working with clients in good faith and
providing genuine individualized attention and support.

However, personal change depends upon numerous factors, including the
client’s circumstances, participation, decisions, commitment, and
actions.

Accordingly, EverChange does not promise or guarantee any
particular outcome or result.

Testimonials, examples, success stories, or descriptions of another
person’s experience do not guarantee that another client will achieve
the same result.

8. WEBSITE INFORMATION

The EverChange website provides general information about its philosophy,
approach, services, and resources.

Website content is provided for informational and educational purposes
and should not be considered individualized coaching merely because it
appears on the EverChange website.

Individual coaching begins through direct communication and an agreed
coaching relationship with the client.

EverChange may revise, update, add to, or remove website information at
any time.

9. FEES, BOOKINGS AND PAYMENTS

Where fees apply, applicable prices and payment arrangements will be
communicated before or when services are purchased or agreed upon.

Any specific payment, cancellation, rescheduling, refund, package, or
service conditions communicated to a client as part of the coaching
arrangement form part of the agreement between EverChange and that
client.

EverChange may change prices or available services prospectively without
altering services already purchased except where otherwise agreed.

10. PRIVACY OF PERSONAL CORRESPONDENCE

Because EverChange coaching is conducted individually, clients may
communicate personal information during the coaching relationship.

EverChange respects the privacy of those communications and will handle
personal information in accordance with its Privacy Policy and applicable
law.

Clients should understand, however, that electronic communications can
carry inherent privacy and security risks. No ordinary email, messaging,
telephone, internet, or electronic communication system can be represented
as absolutely secure.

11. THIRD-PARTY SERVICES

EverChange may use or provide access to third-party communication
platforms, payment processors, websites, resources, or other services.

EverChange does not control independent third parties and is not
responsible for their availability, security practices, privacy practices,
content, or conduct.

12. INTELLECTUAL PROPERTY

Unless otherwise indicated, original EverChange written materials,
coaching resources, exercises, programs, graphics, website content, and
other original materials are owned by or licensed to EverChange.

Materials supplied personally to a client are for that client’s personal
use unless written permission is given for another use.

EverChange materials may not be copied, republished, sold, distributed,
commercially exploited, or represented as another person’s work without
authorization.

13. ACCEPTABLE USE

Clients and website users agree not to misuse the EverChange website,
communications, correspondence, materials, or services.

Harassment, threats, unlawful conduct, impersonation, unauthorized
distribution of protected materials, interference with the website, or
other serious misuse may result in termination of services or access.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, EverChange and those
acting on its behalf will not be liable for indirect, incidental, special,
consequential, or similar losses resulting from reliance upon general
website information or from decisions independently made by a client.

Nothing in these Terms is intended to exclude, waive, or restrict a right
or liability that applicable law does not permit to be excluded, waived,
or restricted.

15. AGE REQUIREMENT

EverChange services are intended for adults (19 years) unless expressly
agreed otherwise.

Where services are offered to a minor, appropriate parental or legal
guardian involvement or consent may be required.

16. TERMINATION OF SERVICES

Either the client or EverChange may end the coaching relationship subject
to any applicable service or payment arrangement already agreed upon.

EverChange may immediately restrict or terminate services in circumstances
involving abusive or threatening conduct, unlawful activity, misuse of
the service, safety concerns, non-payment, or a material violation of
these Terms.

17. CHANGES TO THESE TERMS

EverChange may revise these Terms of Use from time to time. The current
version will be published on the website with its effective or updated
date.

Continued use of the website or services following a revision constitutes
acceptance of the revised Terms to the extent permitted by applicable law.

18. GOVERNING LAW

These Terms and the use of the EverChange website are governed by the
applicable laws of British Columbia and Canada, subject
to any mandatory rights or protections provided by applicable law.

19. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable,
that provision will be limited or interpreted to the extent necessary,
while the remaining provisions will continue in effect to the extent
permitted by law.

20. ENTIRE AGREEMENT

These Terms of Use, the EverChange Privacy Policy, and any specific
written terms agreed upon with an individual client constitute the
applicable terms governing the website and coaching relationship.
